Terms of Service
These Terms govern your use of maimaimai.us, maimaimai.space and MAI MAI MAI sponsor cards (together, the “Site”), operated by King West Group LLC, a Michigan limited liability company (“we”, “us”). By using the Site you agree to these Terms. If you don't agree, please don't use it.
1. What the Site is
The Site is a comedy livestream-style show that links to products sold by third-party retailers. Clips, characters, chat, gifts, timers, viewer counts and news headlines are fiction and satire; see our Affiliate & Content Disclosure. Nothing on the Site is a factual claim, professional advice or a statement that a product is safe or suitable for any use other than the one its maker intends.
2. We don't sell the products
When you click LINK UP you go to a third-party retailer such as Amazon. Any purchase is a contract between you and that retailer, under its terms. The retailer, not us, is responsible for prices, availability, payment, shipping, returns, refunds, warranties and the product itself. We may earn a commission on qualifying purchases. As an Amazon Associate I earn from qualifying purchases.
3. Brands and trademarks
Product names, logos and trademarks shown on the Site belong to their owners and are used only to identify the products. Their appearance doesn't mean the owner sponsors, endorses or is affiliated with us, unless a segment clearly says so.
4. Using the Site
You agree not to:
- use the Site in a way that breaks the law or infringes anyone's rights;
- interfere with, overload, scrape at scale or try to gain unauthorized access to the Site or its systems;
- generate fake or automated clicks on product links, or otherwise manipulate affiliate tracking;
- copy or reuse the Site's content except as these Terms allow.
Anything you type into the chat box stays in your own browser. It isn't published or sent to us.
5. Our content
The Site's content, including the MAI MAI MAI name, the Mai character and artwork, videos, text and design, is owned by or licensed to us and protected by intellectual-property law. You may view and share links to it for personal, non-commercial use. You may embed an unmodified MAI MAI MAI sponsor card using the code we provide, and we may ask you to remove it at any time. Any other use needs our written permission.
6. Third-party sites
The Site links to sites we don't control. We aren't responsible for their content, products, terms or privacy practices.
7. Disclaimers
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT PRODUCT INFORMATION IS COMPLETE OR CURRENT. WE MAKE NO WARRANTY ABOUT ANY PRODUCT SOLD BY A THIRD PARTY.
8. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, KING WEST GROUP LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES AND AGENTS WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR ANY PRODUCT YOU BUY FROM A RETAILER. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE IS LIMITED TO ONE HUNDRED US DOLLARS (US$100). SOME JURISDICTIONS DON'T ALLOW THESE LIMITATIONS, SO THEY MAY NOT ALL APPLY TO YOU.
9. Indemnity
You agree to defend and indemnify us against claims, losses and costs (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the Site.
10. Governing law and disputes
These Terms are governed by the laws of the State of Michigan and applicable US federal law, without regard to conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Michigan, and you and we consent to their jurisdiction. Nothing here limits rights you have under the consumer-protection laws of the state where you live.
11. Changes and termination
We may change the Site or these Terms at any time. If we change the Terms we will update the effective date above, and continued use after that means you accept the change. We may suspend or end access to the Site at any time.
12. Everything else
If any part of these Terms is unenforceable, the rest stays in effect. Our not enforcing a term isn't a waiver. These Terms, together with our Privacy Policy and Affiliate & Content Disclosure, are the entire agreement between you and us about the Site.
